Terms of Sale
These terms apply to every order placed on paxderm.com. Placing an order means you accept them. Please read them alongside our Shipping and Returns pages, which are part of these terms.

Who we are
PaxDerm™ is a brand of Performance Driven Services, LLC, 127 W Hargett St Ste 301, Raleigh, North Carolina 27601, United States.
You can reach us at support@paxderm.com for orders, shipping, and returns, or at sales@paxderm.com for product and sales inquiries.
We answer within one to two business days, Monday to Friday.
Prices, taxes and currency
All prices are shown in United States dollars and do not include sales tax. Sales tax is calculated at checkout based on your shipping address and is shown before you pay.
We may change prices at any time. The price shown at checkout is the price that applies to your order. If a product is listed at an incorrect price because of an error, we may cancel the order and refund you in full rather than supply at that price.
How an order is accepted
Placing an order is an offer to buy. It does not create a contract on its own.
The email you receive immediately after checkout confirms we received your order. It is not acceptance. A contract is formed only when we dispatch your order and send the shipping confirmation, and it covers the items named in that confirmation.
We may decline an order — for example if an item is unavailable, a price was listed in error, we cannot verify payment, or we suspect fraud. If we decline, we will tell you and refund any amount charged.
Payment
We accept payment through Stripe and PayPal. Your payment method is authorized when you place the order and charged when the order is dispatched.
We do not see or store your full credit card details. Our payment processors handle them directly under their own terms and privacy policies.
Shipping, title and risk of loss
Shipping methods, costs and delivery estimates are on our Shipping page. Delivery estimates are estimates, not guarantees, and we are not responsible for carrier delays outside our control.
We ship within the United States only. Title and risk of loss pass to you when the carrier delivers the parcel to the address you gave us.
If a parcel arrives damaged, email support@paxderm.com with a photo within 7 days and we will replace it.
Returns and refunds
You may return any PaxDerm product within 30 days of delivery, opened or unopened. Refunds go to the original payment method within 5 business days of the return arriving.

Product Information
We describe our products as accurately as we can, but color, texture, and packaging may vary slightly between batches. These variations are normal for cosmetic products and are not a defect.
Intended use
PaxDerm products are cosmetics for external use on the skin. They support the skin’s moisture barrier.
They are not drugs. They are not intended to diagnose, treat, cure or prevent any disease or condition. Nothing on this site is medical advice. If you have a skin condition or are under the care of a physician or dermatologist, speak with them before changing your routine.
These products are for external use on the skin and are not intended for children under the age of 13. Keep them out of reach of children.
Avoid contact with the eyes. If the product gets in the eyes, rinse thoroughly with water. If irritation persists, stop use and consult a doctor.
Use each product as directed on its label and on its product page.
Allergy and patch testing
Any cosmetic product can cause a reaction in some people, including products formulated for sensitive skin.
New to a product? Try it on a small area of skin first. If irritation occurs, stop using it.
If you experience a reaction to a PaxDerm product, please tell us at support@paxderm.com. We want to hear about it. Every report is logged and reviewed, and what we learn goes back into the formulas. Thank you for taking the time to tell us. If you would like to return the product, our Returns page explains how.
Disclaimer of warranties
Except as expressly stated in these terms, our products and this website are provided as is and as available, without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim the implied warranties of merchantability, fitness for a particular purpose and non-infringement.
We do not warrant that a product will produce any particular result for your skin. Individual results vary.
Some states do not allow the exclusion of certain implied warranties. Where that is the case, the exclusions above apply only to the extent the law permits, and you may have rights that these terms do not limit.
Limitation of liability
To the fullest extent permitted by law, our total liability for any claim arising from a product or an order is limited to the amount you paid for that order.
We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, whether the claim is based in contract, warranty, negligence or any other theory, even if we were advised such damages were possible.
Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by our negligence, or for fraud. Some states do not allow these limits, so parts of this section may not apply to you.
Disputes, arbitration and governing law
These terms are governed by the laws of the State of North Carolina, without regard to its conflict of law rules.
If a dispute arises, contact us first at support@paxderm.com. Most issues are resolved this way, and we ask that you give us 30 days to do so before starting a formal proceeding.
If we cannot resolve it, you and PaxDerm agree the dispute will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The arbitration will be held in Wake County, North Carolina, or by telephone, video conference or written submission, at your choice. Arbitration fees are allocated under the AAA Consumer Arbitration Rules, and PaxDerm will pay any portion of the filing and arbitrator fees those rules assign to us.
Claims are brought individually. You and PaxDerm each waive the right to bring or take part in a class, collective or representative action, and an arbitrator may not consolidate claims from more than one customer.
Either of us may bring an individual claim in small claims court instead of arbitration, if the claim qualifies.
You may opt out of this arbitration section by emailing support@paxderm.com within 30 days of your first order, stating your name, order number and that you opt out of arbitration. Opting out does not affect any other part of these terms.
If the class waiver above is found unenforceable, this entire arbitration section does not apply, and any dispute will be brought in the state or federal courts located in Wake County, North Carolina.
Changes to these terms
We may update these terms at any time. The version in effect on the date you place an order is the version that applies to that order, and updates do not apply retroactively to orders already placed.
The date at the top of this page shows when it was last updated.
